New Delhi: The Supreme Court came down heavily on the Tamil Nadu government on Wednesday, expressing deep skepticism over its handling of a court-monitored investigation into illegal sand mining in the Vellore district. The bench pointedly asked the state, “Why are you so apprehensive?” highlighting the delay in submitting a crucial report.

The hearing focused on the status of a report prepared by the Court-appointed Special Investigation Team (SIR). The state government’s counsel informed the bench that the report had been received but was still under review, a justification that failed to satisfy the justices.

“The people of Tamil Nadu are waiting. Why are you so apprehensive? If you are not accepting the SIR’s report, then you must state it clearly,” the Supreme Court bench remarked, underscoring the public interest and need for transparency in the matter.

In a move that broadens the scope of the legal proceedings, the apex court also issued a formal notice to the Election Commission of India (ECI). This development is critical as it brings the independent constitutional body into the fold of the case. The Court has sought the ECI’s response, potentially to navigate the legal complexities of an ongoing investigation during the enforced silence of the election Model Code of Conduct.

The case stems from serious allegations of illegal sand mining operations in Vellore. The Supreme Court had earlier established the SIR to ensure an impartial probe into the matter, citing the need for an independent agency to look into the accusations. The state government’s perceived hesitancy in acting upon or making the SIR’s findings public has now become the central point of judicial scrutiny.

The Supreme Court has adjourned the hearing, giving the Tamil Nadu government and the newly-noticed Election Commission time to prepare their responses.
