InterGlobe Aviation, the operator of IndiGo Airlines, has approached the Delhi High Court against Mahindra Electric Automobile Limited (MEAL) for using “6E” in the name of its upcoming electric car, the Mahindra BE 6e. The case is set for a hearing on December 9, 2024, as reported by Bar and Bench on December 3.
The Dispute
- IndiGo holds the trademark for the term ‘6E Link’, registered in 2015 under classes 9, 35, 39, and 16, which broadly cover categories like technology, business operations, and travel.
- The airline claims that Mahindra’s use of “6E” in the name BE 6e could create confusion among consumers and dilute its brand identity.
About Mahindra’s BE 6e
- The Mahindra BE 6e, unveiled alongside the XEV 9e, is expected to hit the market in February 2025.
- Key highlights:
- Range: BE 6e offers an impressive 682 km per charge, while XEV 9e delivers 656 km.
- Price: BE 6e starts at ₹18.9 lakh, and XEV 9e is priced at ₹21.9 lakh (ex-showroom).
- Manufacturing: Both models will be produced at Mahindra’s Chakan plant, with an annual EV capacity of 1.2 lakh units.
Mahindra is committed to investing ₹12,000 crore in its electric vehicle (EV) business, solidifying its presence in the growing EV segment.
Mahindra’s Clarification
In response to the legal challenge, Mahindra Electric has yet to release an official statement but has assured stakeholders that it will address the matter as per the legal process.
IndiGo’s Concerns
IndiGo has been closely associated with the ‘6E’ moniker, which forms a core part of its branding and customer services. The airline believes the use of “6E” by another major company, even in a completely different industry, could lead to:
- Consumer Confusion: The possibility of misinterpreting a connection between the two brands.
- Brand Dilution: Undermining IndiGo’s established reputation as the sole entity using “6E.”
What’s Next?
The Delhi High Court’s decision will likely set a precedent for how trademarks are interpreted across industries. The outcome will determine whether Mahindra can retain the “6e” branding for its electric car or if modifications will be required to avoid legal repercussions.
