Amidst Constitutional Crisis Claims, Speculation of President’s Rule in Delhi Intensifies

The political landscape of Delhi is under intense scrutiny as discussions about the potential imposition of President’s rule in the national capital gather momentum. The Bharatiya Janata Party (BJP) has raised alarms over what it describes as a “constitutional crisis” following Chief Minister Arvind Kejriwal’s continued detention by the Enforcement Directorate (ED). This development has sparked a heated debate on governance and the constitutional framework governing Delhi.

According to sources cited by The Indian Express, high-level deliberations on the prospect of invoking President’s rule are actively ongoing. The Aam Aadmi Party (AAP), through minister Atishi, has labeled such a move as a clear instance of “political vendetta,” underscoring the political tensions at play.

The discussions are reportedly centered around governance challenges highlighted by Delhi’s Lt Governor VK Saxena. In a communication with Kejriwal, Saxena pointed out specific instances, including the contentious delay in the transfer of a medical college principal accused of sexual harassment. This letter has been interpreted by some as evidence of the administrative hurdles currently facing the city.

Amidst these developments, North East Delhi BJP MP Manoj Tiwari has pointed to internal conflicts within the AAP as indicative of the constitutional crisis. He accused Kejriwal of attempting to install his wife as Chief Minister, a move allegedly resisted by AAP legislators. In contrast, AAP’s Saurabh Bharadwaj accuses the Lt Governor of seeking to control Delhi by pushing for President’s rule, a claim he believes is evidenced by the Lt Governor’s actions.

Delhi’s unique constitutional status allows for the imposition of President’s rule under Article 239AB, which legal experts suggest presents a lower barrier for intervention compared to other Indian states. The discussions are said to be focusing on the conditions under which Article 239AB could be invoked, requiring a report from the Lt Governor to the central government as a preliminary step.

The speculation around President’s rule in Delhi has reignited debates on the governance and administrative autonomy of the national capital. As political parties position themselves ahead of potential legal and administrative shifts, the citizens of Delhi await clarity on the future of their city’s governance.
